OPEN TRAFFIC SCHOOL USER AGREEMENT
The following User Agreement is a copy of the
agreement for our CALIFORNIA course.For our TEXAS or NEVADA

BY CLICKING ON ACCEPT BELOW, YOU ARE CONFIRMING THAT
YOU HAVE READ AND AGREE TO THE FOLLOWING TERMS AND CONDITIONS
OF THE OPEN TRAFFIC SCHOOL WEB SITE AND UNDERSTAND THAT THE
FOLLOWING TERMS AND CONDITIONS WILL BIND YOU AND OPEN TRAFFIC
SCHOOL TO A VALID AND ENFORCEABLE CONTRACT:
** REGISTRATION & FEES **
I understand that the Open Traffic School Online
course (the “COURSE”) is an eight (8) hour Traffic
School Course for California.
The COURSE registration fee is $24.95. Payment of the $24.95
registration fee may be made in the following manner: (a) through
our secure online payment system via credit card; (b) sending
a check or money order through US Mail; (c) or by credit card
via telephone to an Open Traffic School representative.
I understand that ALL PAYMENTS ARE FINAL, regardless if I complete
the course or not. I also understand that additional products
and fees will be billed at separate rates.
Should I want to request a refund, I will do so by submitting
a detailed written letter explaining why I believe I am entitled
to a refund in accordance with the COMMUNICATION & TECHNOLOGY
REQUIREMENTS paragraph below. I will send my request to:

I understand that Open Traffic School will promptly investigate
my claim and that if it is determined that there was a technical
problem resting solely upon Open Traffic School’s Web
servers or Web-based applications, then I will receive my refund.
I understand that if Open Traffic School determines that the
technical problem was not the fault of Open Traffic School’s
computers or operating systems, then I am not entitled to a
refund.
** COMMUNICATION & TECHNOLOGY REQUIREMENTS**
I understand that the Open Traffic School course
is an e-learning, internet-dependent, interactive learning service
that requires proper communication via the Internet. I understand
that Open Traffic School makes every reasonable effort to ensure
the proper operation of its technology and internet communication.
However, Open Traffic School cannot guarantee the proper operation
of my (user, student, registrant, etc.) computer, or the Internet.
Open Traffic School SHALL NOT BE LIABLE
for my (user, student, registrant, etc.) inability to complete
the course due to technical problems including, but not limited
to, technical problems with the internet, internet service provider(s),
and/or my own computer or email software.
I have read and understand Open Traffic School's
technical requirements and have determined that I can use this
system. If I plan on taking Open Traffic School’s course
using a Macintosh computer with an older version operating system
than OSX, or if I am using a PC computer running Windows 98
or older operating system, or if I am using the Linux OS, Firefox
or AOL browser, or if I am behind a corporate firewall, I understand
that Open Traffic School’s web-based application may not
function properly and will not be supported.
I understand that Open Traffic School will use
EMAIL as a primary method of communicating important deadlines,
receipts and tracking information about my traffic school course.
I understand that I am responsible for ensuring that all Open
Traffic School emails are not blocked by my email SPAM filters
and that any and all emails that are returned to Open Traffic
School due to mis-information or Spam filters will not be re-sent
unless I make a special request to Open Traffic School to do
so.
** FINAL EXAM **
I understand that the following California Courts require a
supervised final exam with identity verification:
- Alameda
- Kern
- Kings
- San Bernardino
- San Diego
There is no additional fee for taking the final exam at one
of Open Traffic School's Authorized Test Centers. However, if
I opt for the "Notary Edition" of the final exam,
I understand that the notary will directly charge me a fee for
his/her services. This fee is NOT associated with Open Traffic
School, nor does Open Traffic School have any control over the
amount the notary will charge.
** CERTIFICATE OF COMPLETION **
I understand that individual counties have unique
procedures for the delivery of a certificate of completion.
I have read and understand Open Traffic School's procedures
for the county where I have received my citation, in the “How
It Works” section of the Open Traffic School Website.
The following is a summary of Open Traffic School's
certificate delivery procedures as required for certain California
counties (subject to change without notice):
For all courts listed at the following URLs, a certificate
of completion is sent via first class mail:
I understand that once I receive the Certificate of Completion
form Open Traffic School, it is my responsibility to sign the
certificate and forward it to the appropriate Court.
For the courts listed at the following URL, a certificate
of completion is sent to the court by a third party agency,
Coordinated Court Services (CCS):
I understand that once I completed the final exam, I do not
need to do anything further and CCS will forward my certificate
to the court on my behalf.
For the courts listed at the following URL, a certificate of
completion is sent to the court by a third party agency, National
Traffic Safety Association (NTSA):
I understand that once I completed the final exam, I do not
need to do anything further and NTSA will forward my certificate
to the court on my behalf.
For LA County (www.opentrafficschool.com/how/court6.asp)
, a certificate of completion is sent directly to the court
by Open Traffic School via fax. I will receive a copy of the
certificate via first class mail.
I have read and understand Open Traffic School's certificate
delivery schedule. I understand that Open Traffic School processes
certificates of completion Monday through Friday, 9AM-5PM, PST,
excluding holidays. If a course is completed by NOON during
normal business hours, the certificate will be processed the
following business day.
Standard delivery of certificate of completion is via US mail.
I understand that a certificate of completion may take between
to 7 and 10 business days to be received via US mail. Open Traffic
School is not responsible for delays in delivery, damage, or
loss.
I understand that the Certificate of Completion is generated
directly from the information I will enter in the Open Traffic
School registration system. I understand that Open Traffic School
will not be responsible for incorrect information on my certificate
of completion if I provided the information in error during
registration or enrollment. I further understand that there
is a $14.95 processing fee to re-issue a certificate of completion
or a duplicate certificate with corrected information.
THESE TERMS AND CONDITIONS ARE SUBJECT
TO CHANGE BY OPEN TRAFFIC SCHOOL WITHOUT PRIOR NOTICE.
***PERSONAL STATEMENT OF PERJURY***
By registering for the California course, I state
under the penalty of perjury that I and no other person will
read the material in its entirety and I will take the chapter
quizzes and final exams. The certificate of completion will
contain a perjury statement which I will be required to sign
in those jurisdictions which require my direct submission of
the certificate of completion to the court.
I declare that any and all personal biographical information
which I provide to Open Traffic School, Licensed Learning, and/or
any authorized affiliate of Open Traffic School, such as driver
license number, age, social security number, permanent resident
or mailing address and/or name, is true and correct. Furthermore,
by accepting these terms and conditions I understand that it
may be a felony to falsify in any way the documents submitted
to the court.
Open Traffic School will investigate any potential
fraud cases and report any suspected causes of fraud to the
Superior Courts and local law enforcement agencies. The fee
will not be refunded in cases of suspected fraud. The fraud
investigation may delay issuing a certificate of completion.
Any attempt to tamper, illegally access, or in
any way alter the Open Traffic School systems or the certificate
of completion will be prosecuted to the fullest extent of the
law.
BY ACCEPTING THE TERMS OF THIS AGREEMENT,
YOU ARE CONFIRMING THAT YOU HAVE READ THE ABOVE TERMS AND CONDITIONS
AND ARE VERIFYING THAT YOU AGREE TO THE TERMS AS SUMMARIZED
BELOW:
- THE COST OF THE COURSE IS $24.95.
(THIS FEE DOES NOT INCLUDE OTHER PRODUCTS OR SERVICES YOU
MAY DECIDE TO ORDER WHICH WILL BE AN ADDITIONAL CHARGE).
- ALL PAYMENTS ARE FINAL. NO REFUNDS WILL BE GIVEN
UNLESS OUR WEB SERVER ENCOUNTERS UNPLANNED DOWNTIME OR A AN
ERROR BY OPEN TRAFFIC SCHOOL OCCURS FOR YOUR CERTIFICATE DELIVERY
WHICH CAUSED YOU TO MISS YOUR COURT ORDERED DEADLINE. NO OTHER
EXCEPTIONS SHALL APPLY.
- YOU WILL BE USING A COMPUTER CONSISTENT WITH OUR
TECHNOLOGY REQUIREMENTS. MACINTOSH COMPUTERS RUNNING OPERATING
SYSTEMS OLDER THAN OSX, PC COMPUTERS RUNNING WINDOWS 98 OR
LINUX, BROWSERS OTHER THAN INTERNET EXPLORER ARE NOT COMPATIBLE
WITH OUR SYSTEMS. WE ARE NOT LIABLE FOR YOUR FAILURE TO USE
A COMPATIBLE COMPUTER OR SYSTEM AS LISTED ABOVE.
- YOU HAVE READ AND UNDERSTAND THE CERTIFICATE OF
COMPLETION DELIVERY PROCEDURES FOR THE COUNTY THAT ISSUED
YOUR TICKET.
- YOU UNDERSTAND THAT THERE IS NO ADDITIONAL FEE
FOR FINAL EXAM’S TAKEN AT ONE OF OPEN TRAFFIC SCHOOL'S
AUTHORIZED TEST CENTERS. FINAL EXAMS TAKEN WITH A NOTARY WILL
INCUR ADDITIONAL COSTS NOT MONITORED OR SET BY OPEN TRAFFIC
SCHOOL.
- OPEN TRAFFIC SCHOOL ONLY PROCESSES CERTIFICATES
OF COMPLETION MONDAY THROUGH FRIDAY, 9AM-5PM, PST, EXCLUDING
HOLIDAYS. IF A COURSE IS COMPLETED BY NOON DURING NORMAL BUSINESS
HOURS, THE CERTIFICATE WILL BE PROCESSED THE FOLLOWING BUSINESS
DAY.
- THESE TERMS AND CONDITIONS ARE SUBJECT TO CHANGE
BY OPEN TRAFFIC SCHOOL WITHOUT PRIOR NOTICE.
